Food Rescue and Diversion

Senate Bill 1383 (SB 1383) requires food businesses to divert food from landfills by donating the maximum amount of edible food they would otherwise dispose of to food recovery organizations. Tier 1 and 2 generators must have written agreements with food recovery organizations and services and keep records of foods donated.

The City of Murrieta offers all its Tier 1 and 2 generators and food recovery organizations access to a regional food rescue network through a partnership with the Western Riverside Council of Governments. For more information on this free program please visit WRCOG's website
  

How does this impact your business?

Certain food vendors are classified into two groups. Tier 1 Generators must be compliant by 2022 and includes: Grocery stores, Supermarkets, Food Distributers, Food Service Providers, and Wholesale Food Vendors. Tier 2 Generators must be complaint by 2024 and includes: Restaurants, Hotels, Health Facilities, Educational Agencies, and Large Venues. 

By 2024 all generators must comply with the States requirements and:

1) Maintain a contract or written agreement with a Food Recovery Organization; and
2) Maintain a record of donations indicating all types of food being donated in pounds per month, frequency of donations and contact information of contracted Food Recovery Organization utilized.

All Food Rescue Organizations (FRO) service the City of San Jacinto and surrounding communities. 

Persons and non-profits are protected from civil and criminal liability by the Bill Emerson Good Samaritan Food Donation Act when donating food in good faith. For more information the USDA has created a FAQ on the Act available here
